A Gweru teenager employed as a house maid who recently appeared before a Gweru regional magistrate facing allegations of raping her employer's 2 year old son was on Tuesday spared prison.
She was slapped with a wholly suspended 5 year jail term.
Beatrice Sibanda, aged 18, pleaded guilty to aggravated indecent assault when she appeared before regional magistrate Morgan Nemadire.
Nemadire said he considered that the boy’s mother had pleaded with the court to spare her former employee a custodial sentence as she (maid) had shown regret for her actions.
The mother said in court that her son did not get any infection or injuries as a result of the sexual assault.
The state's case was that on June 13 this year and at around 12 PM in Mkoba 15, Sibanda was playing with the complainant together with his brother and niece whilst sitting on the bed.
"Sibanda took the complainant and removed his trousers and pants.
“She also removed her black leg-in and pant which she was wearing and entered into the blankets with the complaint," prosecutor, Prisca Kanhukamwe told the court.
Sibanda then placed the complainant on top of her before inserting his manhood into her privates and engaged in sexual intercourse with him.
When the kids’ mother returned, the complainant's brother told her what Sibanda had done to his brother in the blankets.
The mother reported the matter to the police leading to the arrest of Sibanda.
A medical report, which showed that the boy had been sexually abused, was produced in court as evidence.- New Zimbabwe
