<p dir="ltr">Of late low temperatures have hit the Midlands capital, with snow reportedly falling in Lower Gweru.</p>
<p dir="ltr">According to a police source, all seemed normal last Thursday when the guard commented that the previous night had been extremely cold.</p>
<p dir="ltr">He however was later during the day taken ill, and died.</p>
<p dir="ltr">Meanwhile a body of an elderly man was found in a state of decomposition a few hundred metres from 'Fisher' farm homestead near village 18, Mkoba.</p>
<p dir="ltr">Foul play could not as yet be ruled out in the latest incident.</p>

<p dir="ltr">A few pupils who went to school earlier on were turned away. Parents accompanied their kids to and from kindergarten schools as the commuter omnibuses they pay once a month are not on the road.</p>

<p dir="ltr">Not many pirate taxis, mostly Honda Fit models, are carrying people into and out of town, seeing this as their chance to make money.</p>

<p dir="ltr">OK was using one door at first, but is now fully open. </p>
<p dir="ltr">Some civilian nurses and doctors turned up for work at health institutions such as Gweru Provincial Hospital and Mkoba Poly Clinic.</p>

His passing away on the 21st of August 2015 robbed us at the Bulawayo High Court of a dedicated leader and colleague. May his soul rest in peace.</span><br />

<span style="font-family: "verdana" , sans-serif;">Allow me, to congratulate Justices Mavangira, Bhunu and Uchena on their appointment to the Supreme Court Bench during 2015. These Judges of Appeal also double up as Constitutional Court judges. On behalf of all my colleagues on the High Court bench and on my own behalf I wish the new judges who sit on the highest courts in the land every success in their new roles.</span><br />

<span style="font-family: "verdana" , sans-serif;">During 2015 a further six judges were appointed to the High Court bench. These are Justices Foroma, Charewa, Phiri, Chitapi, Mushore and Munangati-Manongwa. I welcome the fellow judges to the bench. I trust that the appointment of experienced judges to the bench will enhance justice delivery in the High Court.</span><br />

<b><span style="font-family: "verdana" , sans-serif;">Backlog of cases</span></b><br />

<span style="font-family: "verdana" , sans-serif;">I am pleased to inform you that the High Court has put in place various strategies to reduce the backlog of cases that has dogged these court in recent times. There <span style="font-family: "verdana" , sans-serif;">ha<span style="font-family: "verdana" , sans-serif;">s</span> been a marked improvement in the disposal of cases. Currently there is an audit of all files at the High court to determine those cases that have been that have been lying dormant for several year<span style="font-family: "verdana" , sans-serif;">s thus creating a fictitious backlog. I urge all stakeholders<span style="font-family: "verdana" , sans-serif;">, more particularly legal practitioners to ensure that cases they file with the courts on behalf of clients are executed to finality. It is no secret that in criminal cases most appeals against conviction and sentence are lodged for the sole purpose of securing bail on behalf of convicted persons. Once the accused is released on bail pending appeal, the legal <span style="font-family: "verdana" , sans-serif;">practitioner does no<span style="font-family: "verdana" , sans-serif;">thing to prosecute the appeal. Most appeals are u<span style="font-family: "verdana" , sans-serif;">l</span>tim<span style="font-family: "verdana" , sans-serif;">ately dismissed for want o<span style="font-family: "verdana" , sans-serif;">f prosecution. Cases that are not prosecuted clog the system and result in endless applications for condonation for late noting of appeal and leave to appeal out of time. This creates unnecessary pressure on the courts.</span></span></span></span></span></span></span></span><br />

Despite lengthy prison <span style="font-family: "verdana" , sans-serif;">sentences imposed in matters involving violent crime, particularly murders, there is an upsurge of brutal killings <span style="font-family: "verdana" , sans-serif;">committed<span style="font-family: "verdana" , sans-serif;"></span> by persons of both sexes all around the country. Of major concern is that juvenile offenders are also <span style="font-family: "verdana" , sans-serif;">committing</span> heinous <span style="font-family: "verdana" , sans-serif;">and brutal murders. We now live in a socitey where the respect for human life for some people simply do not exist. Knive stabbings <span style="font-family: "verdana" , sans-serif;">have become common and all manner of weapons such as hoes shovels, logs, spears, axes, stones, bricks etc are used are used to inflict injury against fellow human beings over petty disputes. The courts shall continue to impose heavy penalt<span style="font-family: "verdana" , sans-serif;">ies on offenders</span> who show little regard for human life. All institutions on our society namely traditional leaders, chiefs, religious organizations, social organization<span style="font-family: "verdana" , sans-serif;">s must play their part in educating our communities on the need to resolve disputes without resorting to violence</span></span></span>. l</span></span> </span></span></span></span></span></span></span></span><br />
<br />
<b><span style="font-family: "verdana" , sans-serif;">Domestic Violence Child Sexual Abuse and Corruption</span></b><br />
<br />
<span style="font-family: "verdana" , sans-serif;">Cases of domestic violence arising from misunderstandings, and crimes of passion are also on the increase. The Police are commended for apprehending offenders and bringing them to account. The courts must play their part in ensuring that just sentences are imposed on offenders. The public will tend to loses faith in the justice delivery system if convicted offenders are seen to be receiving lenient sentences that do no fit the offence and the offender. All judicial officers are urged to shun corruption as this tends to erode public confidence in the judicial system. I would, in this regard urge all stakeholders to report incidences of corruption where these are detected.</span><br />
<br />
<span style="font-family: "verdana" , sans-serif;">Child sexual abuse is a vice that requires all members of society to fight this evil by reporting any such cases to authorities. No right-thinking member of society can condone, let alone <span style="font-family: "verdana" , sans-serif;">encourage abuse of young children for whatever reason. I urge those religious groups that encourage abuse of young children to think and t<span style="font-family: "verdana" , sans-serif;">hink again. No child should be forced to marry or have sexual relationships with a male person before before the legal age of consent. Child marriages have no place in an<span style="font-family: "verdana" , sans-serif;">y democratic and progressive nation. All offenders and sexual predators must be brought to book<span style="font-family: "verdana" , sans-serif;">. I would propose that a national database be created of all persons convicted of child sexual abus<span style="font-family: "verdana" , sans-serif;">e for the purpose of monitoring sexual vultures who tend to re-offend once released from prison. The appropriate legal framework should be put in p<span style="font-family: "verdana" , sans-serif;">lace to ensure that the tracking of sexual offenders is done without violating the constitutional provisions. I applaud regional magistrates who have handed appropriate sentences for child sexual offenders and say to them they must continue to uphold and enforce the law without fear or favour.</span></span></span></span></span></span></span><br />

Efforts by the Judicial Service <span style="font-family: "verdana" , sans-serif;">Commission</span> to establis<span style="font-family: "verdana" , sans-serif;">h permanent high court stations <span style="font-family: "verdana" , sans-serif;">at Masvingo, Gweru, and Mutare are commended. The current situation is not sustainable. At this <span style="font-family: "verdana" , sans-serif;">Gweru circuit 19 cases have been set down.<span style="font-family: "verdana" , sans-serif;"> These cases are supposed to be dealt within a period of two weeks. The reality is th<span style="font-family: "verdana" , sans-serif;">at the court will only be able to d<span style="font-family: "verdana" , sans-serif;">eal with a limited number of cases, with the rest being rolled over to the next term. The creation of permanent High Court Stations <span style="font-family: "verdana" , sans-serif;">outside Harare and Bulawayo will therefore be a most welcome development to the justice delivery system.</span></span></span></span></span></span></span></span></span></span></span></span></span></span></span><br />

Legal practitioners who take instructions from clients and then go on to frustrate execution of judgements by filing applications for judicial management should desist from that practice. Most applications for Judicial Management are filed and never pursued to the end once credit<span style="font-family: "verdana" , sans-serif;">ors have been frustrated and left to cling to Writs of Execution which they cannot enforce.</span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span></span><br />

Government Minister Saviour Kasukuwere’s order, further said that after council
employees, dubbed ‘Boko Haram’ staged a failed demonstration on 25 November
2015, Muzorera addressed them, repeating allegations that Chingwadza was a
thief who had looted council council funds and property.</span></div>

vakanaka kuchisara imbwa idzi vana Chingwadza…</i>” meaning “good people die
leaving (behind) dogs like Chingwadza. </span></div>

a pregnancy by the parents of a Form Two pupil who was impregnated by
her 30-year-old boyfriend. </span><br />

keeping the pregnancy but her parents convinced Provincial Magistrate
Phathekile Msipa that she was not in a position to be a mother. </span><br />

The matter was heard in camera, but it has since been established that
the girl told the police and nurses at Gweru General Hospital that she
wanted to keep her baby. Her mother, however, applied to the court for

<span style="font-family: Verdana,sans-serif;"> The girl is six weeks pregnant. The girl's mother, in her affidavit, said the pregnancy was as a result of sexual abuse. </span><br />

"On December 25, I learnt that my daughter was pregnant as a result of
sexual abuse. I therefore request that she be allowed to terminate the
pregnancy for the following reasons: 1, she is 14-years-old and cannot
be a mother, 2, she wants to pursue her education without parental
destruction, 3, she is not prepared to look after the baby," said the
girls mother.</span><br />

<span style="font-family: Verdana,sans-serif;"> Meanwhile, the soldier who impregnated the girl has
been jailed for 30 months. He appeared before Gweru Magistrate Gweru
magistrate Musaiwona Shotgame facing one count of having sexual
intercourse with a minor. </span><br />

<span style="font-family: Verdana,sans-serif;"> The soldier will, however, serve 24
months in prison after the magistrate suspended six months of his
sentence on condition of good behaviour. The court heard how the accused
had the girl intoxicated with liquor before having sexual intercourse
with her. </span><br />

<span style="font-family: Verdana,sans-serif;"> The soldier even asked the girl to suck his manhood
after promising her $100. The girl told the court how she was surprised
to see herself bleeding after her first sexual encounter with the
soldier. She said the soldier would bring her into town from Thornhill

<span style="font-family: Verdana,sans-serif;"> Thereafter they would go to his single quarter's room at the airbase for sexual intercourse. </span><br />

"We went to his room and went out and bought three Castle pints and I
drank two of them. Later he slept with me and I bled. I asked him why I
was bleeding and he said that's what women do when they have sex for the
first time," said the girl.</span><br />

told the court that in November last year, the soldier came across the
girl around Thornhill Airbase in Gweru. </span><br />

<span style="font-family: Verdana,sans-serif;"> The court heard how the man proposed love to her and she accepted. </span><br />

"Thereafter on different occasions but still around the month of
November, the accused would invite the victim to his house and drug her
before having sexual intercourse with her several times," said
Balamanje. </span><br />

mother discovered that her daughter was pregnant. She reported the
